1..... CALL TO ORDER - 7:30 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, October 26, 2009 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE

Councillor Calvin, Councillor McGowan and Councillor Murphy were in attendance.  Deputy Mayor Archer and Councillor Day were absent.

Councillor McGowan moved to pay Deputy Mayor Archer and Councillor Day in their absence.

Seconded by Councillor Murphy.  Carried.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Murphy moved to approve the Agenda of October 26, 2009 as presented.

Seconded by Councillor McGowan.  Carried.

6.1 Presentation by River Valley Community Center Foundation  Inc. -     John Webber, CA, Treasurer Presenter

John Webber, CA, Treasurer for the River Valley Community Center Foundation Inc. provided information to Council regarding Community Center operations and Financial Statements year ending December 31, 2008 as well as 2010 Budget information.

Councillor Murphy moved to receive and file the presentation by John Webber, CA, Treasurer for the River Valley Community Center Foundation Inc.

Seconded by Councillor McGowan.  Carried.

Councillor Murphy moved to adopt the minutes of the Regular Council Meeting of October 13, 2009 as presented.

    Councillor Calvin moved to receive and file the minutes of Tourism Committee Meeting of September 17, 2009.

    Councillor McGowan moved to receive and file minutes of the River Valley Community Center Foundation Inc. Board of Directors Meeting of September 15, 2009.

7.4 TELEPHONE POLL OF OCTOBER 19, 2009 RE:  FUNDING FOR COMMERCIAL CORE COLLECTOR ROADWAY

    Councillor Murphy moved to ratify Telephone Poll of October 19, 2009 to approve authorization to carry forward funding for the construction of a new Commercial Core Collector Roadway, Col. Nase Blvd. Project No. 9135.200.001 under the Canada - New Brunswick Provincial - Territorial Base Funding Agreement, into the 2010-2011 fiscal year as per the proposed Construction Schedule and cost estimates prepared by Godfrey Associates Ltd., dated October 9, 2009.

    Seconded by Councillor McGowan.  Carried.

7.5 Tender Notes of June 19, 2009 Re:  Sanitary Force Main - Inglewood Drive Project No. 010-145

    Councillor McGowan moved to receive and file Tender Notes of June 19, 2009 Re:  Sanitary Force Main - Inglewood Drive Project No. 010-145.

Councillor Murphy moved to pay Bills for Payment in the amount of $51,840.58 and Bills for Ratification in the amount of $39,124.57; Grand Total $90,965.15.

    Councillor Calvin moved to receive and file letter of October 8, 2009 from Tammy DeSaulniers, P.R.O. Kids Program Manager Re:  2008 Annual Report.

16. LETTER RECEIVED OCTOBER 16, 2009 FROM DAVID MORGAN, PRINCIPAL, HARBOUR VIEW HIGH SCHOOL RE:  DONATION OF FREE DAY AT HARBOUR STATION/RECREATION DIRECTOR’S REPORT OF OCTOBER 19, 2009

    Councillor McGowan moved to approve the use of the Town’s free day at Harbour Station for Harbour View High School per letter received October 16, 2009 form David Morgan, Principal of Harbour View High School.

17. LETTER OF OCTOBER 9, 2009 FROM FUNDY REGION SOLID WASTE COMMISSION RE:  SUBMISSION OF PROPOSED OPERATING BUDGET FOR THE YEAR 2010

    Councillor Calvin moved to receive and file correspondence of October 9, 2009 from Fundy Region Solid Waste Commission (FRSWC) and to advise the Town’s representative on the Board that Council supports the proposed 2010 FRSWC budget.

    Seconded by Councillor McGowan.  Carried.

    It was noted that the Town would request the figures from the Fundy Region Solid Waste Commission for the previous year for comparison purposes and ask them to be shown in future years.

    Councillor Murphy moved to approve Claim No. 1 and pay relevant invoices per letter of October 15, 2009 from Stephanie B. Patterson, P. Eng., Godfrey Associates Ltd. Re:   Commercial Core Collector Roadway (Colonel Nase Boulevard), Grand Bay-Westfield, NB, RDC Project Nos. 4253.037.013 and 9135.200.001, Project No. 010-149.

19. DEVELOPMENT OFFICER’S REPORT OF OCTOBER 20, 2009 RE:  RENOVATIONS TO FIRE STATION NO. 2

    Councillor Murphy moved to approve renovations, as defined by contract documents prepared by Steen Knorr Architecture Inc., dated September 28, 2009, within Fire Station No. 2 currently leased by Ambulance New Brunswick, with construction to commence upon approval of a new 5-year Lease Agreement developed by the Town’s Solicitor and being signed by both parties, to include both the base rental fee and the fixed term repayment fee for the additional costs of the renovations.

20. RECREATION DIRECTOR’S REPORT OF OCTOBER 21, 2009 RE:  SNOW GUARD FOR CENTRUM

    Councillor McGowan moved to authorize staff to proceed with the supply and installation of the snow guard and to repair damage to existing eaves trough and roof at the Centrum up to an amount of $13,400 plus HST.

21. River Centre Manager’s Report of October 22, 2009 Re:  UNeSCO Geopark Memorandum of Understanding Request

    Councillor Murphy moved to approve the signing of the UNESCO Geopark Memorandum of Understanding between the Town of Grand Bay-Westfield and the Saint John Waterfront Development Corporation, custodian of the Geopark Project.

    Seconded by Councillor McGowan.  Carried.

22. FACSIMILE OF OCTOBER 21, 2009 FROM KENNETH W. HANNAH, P. ENG., GODFREY ASSOCIATES LTD. RE:  CMHC LOAN APPLICATION FOR COLONEL NASE BOULEVARD

    Councillor Murphy moved to apply to CMHC under the Municipal Infrastructure Lending Program - Housing Related Infrastructure for a loan in the amount of $1,393,000 being the estimated residential housing related portion of the municipal share of costs for the construction of Colonel Nase Boulevard acknowledging that this project has received approval for construction from the New Brunswick Department of Environment Environmental Impact Assessment and that contributions have been approved for additional project costs by the Regional Development Corporation and also under the Canada - New Brunswick - Territorial Base Funding Agreement.

23. TOWN MANAGER’S REPORT OF OCTOBER 16, 2009 RE:  VARIOUS FEES 2010

    Councillor McGowan moved to adopt Various Town Fees dated October 16, 2009 effective January 1, 2010 (copy attached).

    Seconded by Councillor Calvin.  Carried.

    It was noted that all fees would stay the same as 2009 with the addition of a fee for “Search & Preparation of Public Documents”.

24. WORKS COMMISSIONER’S REPORT OF OCTOBER 21, 2009 RE:  VEHICLE REPLACEMENTS, 2001 ½ TON AND 2000 ¼ TON

    Councillor Murphy moved to purchase a 2010 Ford Ranger 4x4 and a 2010 Ford F-250 from Downey Ford per quote dated October 15, 2009 with delivery within one week from date of purchase order and the Bumper to Bumper 5 year/100,000 km warranty be purchased extra and move that in future requests and tendering for vehicles occur in the current year with actual purchase/delivery in the following year.
