The Town of Grand Bay-Westfield Council met in a regular session on Monday, October 27, 2003 at 7:35 p.m. with  Mayor Losier presiding.

APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved the agenda of October 27, 2003  be approved as presented.

PUBLIC HEARINGS
 
5.1 PRESENTATION BY FIRE CHIEF DAN MCCOY
RE:  PROPOSED ELECTRIC PUMP HOUSE MORNINGSIDE CRESCENT/REQUEST FOR PUBLIC INPUT

Bruce Cummings of Morningside Crescent spoke in opposition to the proposed  Electric Pump House for Morningside Crescent suggesting two alternate locations for the Pump House: 1) future street adjacent to the Ridge Way Tot Lot, 2) property owned by the Wesleyan Church.

Claudette Ross of Morningside Crescent expressed her opposition to the proposed Pump House suggesting property at the base of Woolastook Drive, owned by the School District, as an alternate location.  Mrs. Ross noted concerns regarding maintenance of the proposed site and its location adjacent to residential properties.

Councillor Day moved to table the presentation by the Fire Chief Re:  Proposed Electric Pump House - Morningside Crescent for the next Council Meeting of November 12, 2003.

Seconded by Councillor  Silliphant.  Carried.

PUBLIC PRESENTATIONS
 
6.1  MILT SHERWOOD, MLA ATTENDING RE:  VARIOUS  MATTERS
1) School Street – MLA Sherwood advised a meeting had been held  with Mr. Boyce of the School District
    and that funding for upgrading of the street has not as yet been identified and he will pursue the matter
    further. 

2) Exit from Route #7 to the Town – MLA Sherwood advised a meeting  has not as yet been scheduled with
    the Minister of Transportation, however he will pursue the matter.

3) Standard Investment Property Update – MLA Sherwood advised  tests were not finalized at this point in
    time and Council would receive a copy of the results once available.

MINUTES OF  REGULAR COUNCIL MEETING OF OCTOBER 14, 2003

Councillor Murphy moved to adopt the minutes of the regular Council meeting of  October 14, 2003 as presented.

MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF OCTOBER 6, 2003

Councillor Day moved to receive and file the minutes of the Planning Advisory  Committee meeting of October 6, 2003.

Seconded by Councillor Murphy.  Carried.
 

7.2  TELEPHONE POLL OF OCTOBER 15, 2003
RE: RESCHEDULING OF COUNCIL SESSION OF NOVEMBER 10, 2003

Councillor Day moved to ratify the Telephone Poll of October 15, 2003 
to reschedule the Council Session of November 10, 2003 to November 12, 2003.

Seconded by Councillor Murphy.  Carried.

Councillor Day moved to ratify the Telephone Poll of September 12, 2003 Re:  Personnel Matter.

BILLS FOR PAYMENT

Councillor Day departed the meeting due to a stated  conflict of interest.

Deputy Mayor McGowan moved to approve item number 19 on Bills for Ratification:

Councillor Day rejoined the meeting.

Mayor Losier thanked BeBe the Clown for the discounted price on the invoice regarding the Volunteer Fire Department Open House.

Deputy Mayor McGowan moved to pay the Bills for Payment enbloc for a total of $38,380.87 and approve Bills for Ratification for a total of $59, 097.18 for a Grand Total of $97,478.05.

Seconded by Councillor Silliphant.  Carried.

16. MAY 2003 DATA FROM HUMAN DEVELOPMENT COUNCIL 
RE:  INFO-LINE ETC./BROUGHT FORWARD FROM OCTOBER 14, 2003

Councillor Murphy moved to contribute $1,000.00 to the  Human Development Council for 2003. 

Seconded by Deputy Mayor McGowan.  Carried.

It was noted the Human Development Council supports a wide range of service groups and organizations in the region.
 

17. WORKS COMMISSIONER’S REPORT OF OCTOBER 8, 2003
RE:  VACUUM STREET SWEEPING TENDER NO. T10-2003/BROUGHT FORWARD FROM OCTOBER 14, 2003

 Councillor Silliphant moved to award  Tender No. T10-2003  to John Sweeping Inc. for Vacuum Street Sweeping Service for $29,671.72 per year for a total two-year cost of $59,343.44 for 2004 - 2005.

 Seconded by Deputy Mayor McGowan.  Carried.
 

18. LETTER FROM GODFREY ASSOCIATES LTD. DATED OCTOBER 6, 2003
RE:  WASTEWATER PUMPING STATION NO. 3 REPLACEMENT – GEORGE STREET, PROJECT NO. 010-095, CERTIFICATE NO. 6

 Councillor McGowan moved to pay Keel Construction Ltd. $206.17 Re:  Wastewater Pumping Station No. 3 Replacement – George Street, Project No.010-095, Certificate No. 6.

 Seconded by Councillor Murphy.  Carried.
 

19.  LETTER OF OCTOBER 17, 2003 FROM FUNDY REGION SOLID WASTE COMMISSION
RE:  SUBMISSION OF PROPOSED OPERATING BUDGET FOR THE YEAR 2004

Deputy Mayor McGowan  moved to table the letter of October 17, 2003 from the Fundy Region Solid Waste Commission and to invite the Commission’s General Manager, Jack Kier and the Town’s Board Representative, Richard McLean to meet with Council on November 12, 2003 regarding the Commission’s 2004 Operating Budget.

Seconded by Councillor Day.  Carried.
 

20.  LETTER OF OCTOBER 13, 2003 FROM HON. BRENDA FOWLIE, MINISTER OF ENVIRONMENT
AND LOCAL GOVERNMENT RE:  NB CLEAN WATER PROGRAM GRANT FOR MUNICIPAL WATER SOURCE IDENTIFICATION PROJECT

Councillor Day moved to receive and file letter of October 13, 2003 from Hon. Brenda Fowlie, Minister of the Environment and Local Government Re:  NB Clean Water Program grant to the Municipality for $10,000.

Seconded by Councillor  Murphy.  Carried.

It was noted the $10,000 grant to the Town is to assist with identifying a water source for the community.
 

21. LETTER OF OCTOBER 8, 2003 FROM DON HARRIMAN, THE KIDNEY FOUNDATION OF 
CANADA RE:  MARCH IS KIDNEY MONTH 

Councillor Silliphant moved to receive and file letter of October 8, 2003 from Don Harriman, The Kidney Foundation of Canada Re:  2004 March Campaign.

Seconded by Councillor  Murphy.  Carried.
 

22. APPLICATION TO ACQUIRE TITLE TO THE LAND CONTAINED IN A ROAD, STREET, LANE,
ALLEY OR WAY RE:  94 NEREPIS ROAD/REPORT OF OCTOBER 23, 2003 FROM DEVELOPMENT OFFICER

Deputy Mayor McGowan  moved to accept the application for road closure from Pamela and Dallas Urquhart of 94 Nerepis Road for closing a certain portion of Hillandale Drive located between PID#s 0022098 and 30144166 from Nerepis Road to a point joining the south-east corner of PID# 30144166 and the north-west corner of PID# 30144174, maintaining the minimum 30.48 m width of the re-aligned portion of Hammond Road, subject to the Town’s Policy on Street Closures #E005 and following procedures as set out in section 187 of the Municipalities Act.

Seconded by Councillor  Murphy.  Carried.
 

23.  RCMP STATISTICAL REPORTS FOR AUGUST AND SEPTEMBER 2003/BROUGHT FORWARD
FROM OCTOBER 14, 2003 

Deputy Mayor McGowan moved to receive and file the RCMP  Statistical Reports for August and September 2003. 

 Seconded by Councillor Murphy.  Carried.
 

24.  LETTER OF OCTOBER 15, 2003 FROM HON. BRENDA FOWLIE, MINISTER OF ENVIRONMENT
AND LOCAL GOVERNMENT RE:  WASTEWATER SYSTEM IMPROVEMENTS  PROJECT NO. 63.37.05.431.02

Councillor Day moved authorization for appropriate signatures for the agreement for Project No. 63.37.05.431.02 for Wastewater System Improvements for the Town of Grand Bay-Westfield.

Seconded by Councillor  Murphy.  Carried.
