1..... CALL TO ORDER - 7:30 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, September 27, 2010 with Mayor Losier presiding.
2. RECORD OF ATTENDANCE

Councillor Calvin, Councillor Day, Councillor McGowan and Councillor Murphy were in attendance; Deputy Mayor Archer was absent.

    Councillor Day moved to pay Deputy Mayor Archer in her absence.

    Seconded by Councillor McGowan.  Carried.
3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved to approve the agenda of September 27, 2010 as presented.

Seconded by Councillor Murphy.  Carried.

DRAFT MOTION RE:  HISTORIC PLACES OF INTEREST PROGRAM PER COUNCILLOR MURPHY, TOURISM COMMITTEE CHAIR

    Councillor Murphy moved that the Town of Grand Bay-Westfield agrees to participate in the Historic Places of Interest Program and will create a register of Historical Places and further moved to mandate the Grand Bay-Westfield Tourism Committee to document the places and populate the register.

Patterson, P. Eng., Dillon Consulting.

19. MEMORANDUM OF SEPTEMBER 22, 2010 FROM THE PLANNING ADVISORY COMMITTEE/DEVELOPMENT OFFICER’S REPORT RE:  TENTATIVE SUBDIVISION APPROVAL (RECOMMENDATION TO COUNCIL - 15 LOTS) RE:  OAKHILL HOMES/WAYNE C. MACLEOD - VALLEY VIEW ESTATES SUBDIVISION, PHASE 10 RIDGEWAY

Councillor Murphy moved to approve Tentative Subdivision Plan, Valleyview Estates Phase 10 as prepared by Kierstead Quigley & Roberts dated September 15, 2010 subject to approval of the following conditions:

a)
review and acceptance of road design by the Town Engineer    (Dillon) and the approval of the Department of Environment for the approval to extend sanitary sewer services;
b)
no blasting to occur in the development of the subdivision without confirmation of a pre-blast survey, copy of licensed Blaster credentials and proof of liability insurance to the approval of Council;
c) recording of NB Power Utility Easements on the Final Subdivision Plan;
d) approval of Subdivision Developer’s Agreement complete with security for completion of the work prior to Final approval of the Subdivision, and
e)
recording of civic numbers on the final Subdivision Plan, and
further moved that Council accept 1093 m² Land for Public Purposes to be assigned to the existing Land for Public Purposes Land Bank (leaving a total of 0.1737 ha or 8.08% of the total Land Bank for future subdivisions) for the creation of 15 new building lots as shown on the Tentative Subdivision Plan, Valleyview Estates Subdivision -Phase 10, as prepared by Kierstead Quigley & Roberts Ltd. dated September 15, 2010.

20. WORKS COMMISSIONER’S REPORT OF SEPTEMBER 23, 2010 RE:  2010 – 2011 SEWER CAPITAL BUDGET REQUESTS

    Councillor Day moved to authorize the Municipality of Grand Bay-Westfield to submit to the Municipal Capital Borrowing Board an application for authorization to borrow in an amount not to exceed $200,000.00 for a term not to exceed fifteen years for the following purposes:

    Environmental Health Services - Sewerage System Upgrading - lagoon and manhole upgrades,

    and further moved to authorize Dillon Consulting to prepare the tender for lagoon dredging with award subject to borrowing approval.

C.U.P.E. LOCAL 2404/TOWN OF GRAND BAY-WESTFIELD COLLECTIVE AGREEMENT

    Councillor Murphy moved to ratify changes to C.U.P.E. Local 2404/Town of Grand Bay-Westfield Collective Agreement per information sheet from the Town’s consultant Pierre Bertrand for a four year agreement January 1, 2010 - December 21, 2013 and to approve appropriate signatures subject to a final review by the Town’s Consultant.

MEMORANDUM OF SEPTEMBER 22, 2010 FROM THE PLANNING ADVISORY COMMITTEE/DEVELOPMENT OFFICER’S REPORT RE:  RECOMMENDATION TO COUNCIL, MAGUIRE EXCAVATING LTD. - PANORAMIC ESTATES SUBDIVISION, JUNE AVENUE EXTENSION/WEAVER TERRACE

    Councillor Day moved approval of the proposed Tentative Subdivision Plan, Panoramic Estates Subdivision Phase 6 as prepared by Kierstead Quigley & Roberts Ltd., dated September 15, 2010, subject to the following general conditions prior to completion of Subdivision Developer’s Agreement and approval of Final Subdivision Plan:

i) 
review of street design extension by the Dillon Consulting (acting as Town Engineer), including approval by the Department of Environment for the extension of sanitary sewer services for recommendation to Council for final approval;
ii) note that no blasting will occur in the development of the subdivision without a pre-blast survey and proof of liability insurance to the approval of Council;
iii) recording of NB Power Utility Easements on the Final Subdivision Plan;
iv) recording of civic addresses on the Final Subdivision Plan;

and further that Council accept $13.40, Money in Lieu of Land For Public Purposes (cash, debit, money order, or certified cheque) for the creation of one new building lot as shown on the Tentative Subdivision Plan, Panoramic Estates Subdivision Phase 6 as prepared by Kierstead Quigley & Roberts Ltd., dated September 15, 2010, and;


    that Council assent to the proposed Public Street to be shown as June Avenue (Public) on the Final Subdivision Plan.

Seconded by Councillor Murphy.  Carried.
23. WORKS COMMISSIONER’S REPORT OF SEPTEMBER 23, 2010 RE:  PURCHASE OF STORAGE CONTAINER

    Councillor Murphy to authorize staff to purchase a cargo ship container unit for the Sanitary Sewer Utility.

    Seconded by Councillor Calvin.  Carried.
