The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, June 28, 2010 with Deputy Mayor Archer presiding.

2. RECORD OF ATTENDANCE

Councillor Calvin, Councillor McGowan, and Councillor Murphy were in attendance.  Mayor Losier and Councillor Day were absent.

Councillor McGowan moved to pay Mayor Losier and Councillor Day in their absence.

    Seconded by Councillor Murphy.  Carried.*

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor McGowan moved to approve the agenda of June 28, 2010 and add item No. 6.1 - Good News Item.

Seconded by Councillor Calvin.  Carried unanimously.*

4. DISCLOSURE OF CONFLICT OF INTEREST

Councillor Calvin stated a Conflict of Interest with Item No. 25 on Bills for Payment.

6.1 GOOD NEWS ITEM

Councillor McGowan noted that the Volunteer Fire Department Recruitment Drive on June 21, 2010 was a great success with 23 persons attending.

7.4 TOURISM COMMITTEE MEETING MINUTES OF MAY 20, 2010

    Councillor Murphy moved to receive and file Tourism Committee Meeting Minutes of May 20, 2010.

    Councillor Calvin departed the meeting.

Councillor Murphy moved to pay item No. 25 on Bills for Payment in the amount of $500.00.

Seconded by Councillor McGowan.  Carried.*

Councillor Calvin rejoined the meeting.

Councillor Murphy moved to pay Bills for Payment in the amount of $206,883.07 and Bills for Ratification in the amount of $68,403.87; Grand Total $275,286.94.

    Councillor Murphy moved to pay to Maguire Excavating Ltd. $2,712.00 Re: Final Holdback Release Tennis Court and Ball Field Improvements, Inglewood Drive, Grand Bay-Westfield, NB, Project No. 010-150 per letter of June 15, 2010 from Clayton Rogers, P. Eng., Dillon Consulting.

    It was noted that Town staff would determine if the Tennis Courts are utilized more since improvements were made.

    Councillor Murphy moved subject to receiving approval from the Department of Transportation to award the contract to the low tenderer, Morin Curbing Inc., for the tender price of $153,684.30 HST included for Concrete Curb and Gutter and Sidewalk, River Valley Drive (Rte. 177) (Epworth Park Road to Stevens Court) Grand Bay-Westfield, NB, N.B.D.O.T. No. 10-D478, Project No. 10-3348, per letter of June 21, 2010 from Clayton Rogers, P. Eng., Dillon Consulting.

21. DEVELOPMENT OFFICER’S REPORT OF JUNE 21, 2010 RE:  WARRANTEE HOLD BACK RELEASE, PANORAMIC ESTATES SUBDIVISION, PHASE 4

    Councillor Murphy moved to release the Letter of Credit from Scotiabank dated May 28, 2009 for the amount of $34,100.00 for completion of the Warrantee Period for Panoramic Estates Subdivision, Phase 4, as set out in the Town’s Subdivision Developer’s Agreement with Maguire Excavating Ltd.

22. MEMORANDUM OF JUNE 23, 2010 FROM PLANNING ADVISORY COMMITTEE RE:  APPLICATION FOR SUBDIVISION APPROVAL/RECOMMENDATION TO COUNCIL - JAMES ALLEN SHAW SUBDIVISION - LOT 10-1/DEVELOPMENT OFFICER’S REPORT OF JUNE 23, 2010

    Councillor McGowan moved to accept $1,106.69, as money in Lieu of Land for Public Purposes requirements (cash, money order, certified cheque or debit) for the purpose of creating one new building lot on Woolastook Drive, out of PID No. 30174650, as shown on the Tentative Subdivision Plan, James Andrew Shaw Subdivision, Lot 10-1, as prepared by DeSaulniers Surveys Inc. and (undated) with approval of Final Subdivision plan subject to:

(a)Payment of $1,106.69 (cash, money order, certified cheque or debit);
(b)recording of signatures for the Public Utility Easements;
(c)recording of Civic Number “138” for Lot 10-1 on the Final Subdivision Plan.
