1. CALL TO ORDER - 7:30 P. M.
The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, May 28, 2007 with Mayor Losier presiding.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Councillor Day moved to add Item No. 23.a to the agenda - Letter of May 15, 2007 from Stephanie B. Patterson, P. Eng., Godfrey Associates Ltd.  Re: Waterfront Development Brundage Point Trailhead, Project Nos. 010-116 & 010-125, Claim No. 11.

Seconded by Councillor McGowan.  Carried unanimously.

6.2 PRESENTATION BY CANADIAN COAST GUARD
RE:  OPERATIONS FROM FERRY ROAD WHARF - PHIL WALKER PRESENTER

Phil Walker, SAR Preparedness Officer presented Council with a description of the services being offered by the Canadian Coast Guard in our area.  Mr. Walker introduced Council to members of the Coast Guard Team which will be available from Victoria Day to Labour Day to serve in Search & Rescue on the St. John River.  Mr. Walker thanked Council for allowing the Coast Guard to dock at the Ferry Road Wharf adjacent to Brundage Point for the season.
 

7. MINUTES OF REGULAR COUNCIL MEETING OF MAY 14, 2007
Deputy Mayor Murphy moved to adopt the minutes of the Regular Council Meeting of May 14, 2007 as presented.

7.1 MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF MAY 7, 2007
Councillor McGowan moved to receive and file Minutes of Planning Advisory Committee Meeting of May 7, 2007.

7.2 MINUTES OF EMERGENCY MEASURES ORGANIZATION MEETINGS OF MARCH 20, 2007 AND
APRIL 17, 2007

 Deputy Mayor Murphy moved to receive and file Minutes of Emergency Measures Organization Meetings of March 20, 2007 and April 17, 2007.

 Seconded by Councillor Evans.  Carried.
 

7.3 TELEPHONE POLL OF MAY 22, 2007 RE:  RIVER VALLEY MIDDLE SCHOOL RAVE RUN
Councillor Day moved to ratify the Telephone Poll of May 22, 2007 in that approval is granted for the proposed River Valley Middle School Rave Run to be held Saturday, June 2, 2007 per letter of April 11, 2007 from David Shiels of River Valley Middle School subject to permission of the Team Leader of the RCMP and the District Engineer of the New Brunswick Department of Transportation.

 Seconded by Deputy Mayor Murphy.  Carried.

7.5 TENDER NOTES OF MAY 24, 2007 RE:  STREET IMPROVEMENTS 2007, PROJECT NO. 010-126
Councillor Day moved to receive and file Tender Notes of May 24, 2007 Re:  Street Improvements 2007, Project No. 010-126.

8. BILLS FOR PAYMENT
Councillor Day moved to pay Bills for Payment enbloc for a total of $8,943.00 and Bills for Ratification for a total of $42,905.64; grand total of $51,848.64.

 Seconded by Deputy Mayor Murphy.  Carried.

Councillor Day moved to cancel the Regular Council Meetings of July 23, 2007 and August 27, 2007 with a Special Council Meeting to be called, if required.

17. LETTER OF APRIL 20, 2007 FROM HON. JOHN W. FORAN, MINISTER OF PUBLIC SAFETY AND
SOLICITOR GENERAL RE:  WATER RESCUE ON IN LAND WATERWAYS

Deputy Mayor Murphy moved to receive and file letter of April 20, 2007 from Hon. John W. Foran, Minister of Public Safety and Solicitor General Re:  Water Rescue on In Land Waterways.

19. FACSIMILE RECEIVED MAY 11, 2007 FROM MARC MACLEOD, GENERAL MANAGER, 
FUNDY REGION SOLID WASTE COMMISSION RE:  TRANSPORTATION OF SOLID WASTE OUTSIDE THE PROVINCE

 Councillor Evans moved to forward a letter to the Minister of the Environment objecting to Transportation of Solid Waste Outside of the Province with a copy to be forwarded to Marc MacLeod, General Manager, Fundy Region Solid Waste Commission.

20. LETTER OF MAY 3, 2007 FROM BOB MANNING, CHAIR - MULTIPLEX COMMITTEE
LETTER OF MAY 2, 2007 FROM NORM MCFARLANE, MAYOR, CITY OF SAINT JOHN RE:  REQUEST FOR FUNDING PARTICIPATION - NEXT PHASE OF THE GREATER SAINT JOHN MULTIPLEX RECREATION AND SPORT FACILITY PROJECT
 

 Deputy Mayor Murphy moved to forward a letter to Bob Manning, Chair - Multiplex Committee with a copy to Norm McFarlane, Mayor of Saint John advising them the proposed Multiplex, although on our wish list, is not a priority at this time therefore funding from our Municipality is not available for the project.

 Seconded by Councillor McGowan.  Carried.
 

21. MEMORANDUM OF MAY 22, 2007 FROM PLANNING ADVISORY COMMITTEE 
RE:  RECOMMENDATION TO COUNCIL - TENTATIVE SUBDIVISION APPROVAL - LINDA MCCULLOUGH SUBDIVISION, LOTS 07-1 & 07-2/DEVELOPMENT OFFICER’S REPORT OF MAY 23, 2007

 Councillor Day moved to concur with the recommendation of the Development Officer dated May 23, 2007 to approve the payment of $631.19 (cash, money order or certified cheque) for Money in Lieu of Land for Public Purposes for the creation of one new building lot as shown on the Tentative Subdivision Plan, Linda McCullough Subdivision, 523 River Valley Drive, as prepared by DeSaulniers Surveyors Inc., dated May 16, 2007, for approval by the Development Officer of the Final Subdivision Plan.

 Seconded by Deputy Mayor Murphy.  Carried.
 

22. MEMORANDUM OF MAY 22, 2007 FROM PLANNING ADVISORY COMMITTEE
RE:  RECOMMENDATION TO COUNCIL - TENTATIVE SUBDIVISION APPROVAL - JAMES SHAW SUBDIVISION, LOT 07-01/DEVELOPMENT OFFICER’S REPORT OF MAY 23, 2007

Councillor McGowan moved to concur with the recommendation of the Development Officer dated May 23, 2007 to approve the payment of $156.94 (cash, money order or certified cheque) for Money in Lieu of Land for Public Purposes for the creation of one new building lot as shown on the Tentative Subdivision Plan, James & Margaret Shaw Subdivision, 97 Woolastook Drive, as prepared by DeSaulniers Surveyors Inc., undated, for approval by the Development Officer of the Final Subdivision Plan.

 Seconded by Councillor Day.  Carried.
 

23. MEMORANDUM OF MAY 23, 2007 FROM DEVELOPMENT OFFICER
RE:  FINAL SUBDIVISION APPROVAL AND REQUEST FOR PARTIAL COMPLETION TO ESTABLISH BONDING REQUIREMENTS RE:  SUBDIVISION DEVELOPER’S AGREEMENT - PANORAMIC ESTATES SUBDIVISION, PHASE 4

 Councillor Evans moved to accept the recommendation from the Town Engineer (Godfrey Associates Ltd.) dated May 11, 2007 to accept the Certificate of Completion (revised date of May 14, 2007) prepared by ADI Limited as a Partial Completion of the work described as Panoramic Estates Subdivision, Phase 4 forming a partial release of security for the total project, reducing the total required security to a value of $34,100.00 and further moved to approve signing authority on the Subdivision Developer’s Agreement for the Final Subdivision Plan, Panoramic Estates Subdivision, Phase 4, Town of Grand Bay-Westfield, Parish of Westfield, Kings County, New Brunswick, as prepared by Kierstead Quigley & Roberts Ltd. and dated April 23, 2007 and under section 56(1) of the Community Planning Act, assent to the Plan for the vesting of public streets, prior to Final Approval being granted by the Development Officer subject to final receipt and final review of contract documents to the satisfaction of the Town Solicitor of all required documents, including outstanding Security and Insurance Certificates and payment of $59.70 (cash, money order, certified cheque or debit).

GODFREY ASSOCIATES LTD.  RE: WATERFRONT DEVELOPMENT, BRUNDAGE POINT TRAILHEAD, GRAND BAY-WESTFIELD, PROJECT NOS. 010-116 & 010-125, CLAIM NO. 11

 Councillor Day moved to approve Claim No. 11 for Project Numbers 010-116 and 010-125, Waterfront Development, Brundage Point Trail Head per letter of February 20, 2007 from Stephanie Patterson, P.Eng., Godfrey Associates Ltd. with authorization for payment of relevant invoices.

 Seconded by Deputy Mayor Murphy.  Carried.
