1.  CALL TO ORDER
The Town of Grand Bay-Westfield Council met in a Special Meeting on Wednesday, May 5, 2004 at 5:10 p.m. with Mayor Losier presiding.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Deputy Mayor McGowan moved to add item 7.c to the agenda - Telephone Poll of May 3, 2004 Re:  Amendment to Don Myles Section 39 Agreement.

Seconded by Councillor Murphy.  Carried unanimously.

5. BILLS FOR PAYMENT
Councillor Day moved to pay Bills for Payment enbloc for a total of $75,845.11 and Bills for Ratification for a total of $24,305.74, Grand Total $100,150.85.

Seconded by Deputy Mayor McGowan.  Carried.

6.1 READING IN ITS ENTIRETY OF BY-LAW NO. 103, TOWN OF GRAND BAY-WESTFIELD
BY-LAW TO CLOSE CERTAIN PUBLIC STREETS OR RIGHTS –OF-WAYS

Deputy Mayor McGowan moved Reading in its Entirety of By-law No. 103, Town of Grand Bay-Westfield By-law to Close Certain Public Streets or Rights-of-Way.

Seconded by Councillor Day.  Carried.

 By-law No. 103 was read in its entirety.
 

6.2 THIRD READING BY TITLE AND ENACTMENT OF BY-LAW NO. 103, TOWN OF 
GRAND BAY-WESTFIELD BY-LAW TO CLOSE CERTAIN PUBLIC STREETS OR RIGHTS-OF-WAY

Councillor Silliphant moved Third Reading by Title and Enactment of By-law No. 103, Town of Grand Bay-Westfield By-law to Close Certain Public Streets or Rights-of-Way.

Seconded by Councillor Day.  Carried.

By-law No. 103 was read a third time by title and enacted.
 

6.3 READING IN ITS ENTIRETY OF BY-LAW NO. 104, TOWN OF GRAND BAY-WESTFIELD
BY-LAW RESPECTING THE REMUNERATION OF THE MAYOR AND COUNCIL OF THE TOWN OF GRAND BAY-WESTFIELD

Deputy Mayor McGowan moved Reading in its Entirety of By-law No. 104, Town of Grand Bay-Westfield By-law Respecting the Remuneration of the Mayor and Council of the Town of Grand Bay-Westfield.

Seconded by Councillor Murphy.  Carried.

Councillor Day moved Declaration of an Emergency Re:  Draft By-law No. 105, Town of Grand Bay-Westfield By-law Respecting Dangerous or Unsightly Premises within the Town of Grand Bay-Westfield.

Seconded by Councillor Silliphant.  Carried unanimously.

2004 STREET IMPROVEMENTS – PROJECT NO. 010-108

 Councillor Murphy moved to receive and file Tender Notes of April 26, 2004 Re:  2004 Street Improvements – Project No. 010-108.

 Seconded by Councillor Silliphant.  Carried.
 

7.b LETTER OF APRIL 26, 2004 FROM CLAYTON ROGERS, P. ENG., GODFREY ASSOCIATES LTD.
RE:  2004 STREET IMPROVEMENTS, VARIOUS LOCATIONS – GRAND BAY-WESTFIELD, NB, PROJECT NO. 010-108/FACSIMILE RECEIVED APRIL 30, 2004 FROM CLAYTON ROGERS, P. ENG. GODFREY ASSOCIATES LTD.

 Councillor Day moved to concur with the recommendation of Godfrey Associates Ltd. and award the contract to the low bidder L. Halpin Excavating Limited for $190,965 including HST with a hold on the Wong Way work to address acquisition of an easement or land for installation of  storm sewer.

 Seconded by Councillor Murphy.  Carried.
 

7.c TELEPHONE POLL OF MAY 3, 2004
RE:  AMENDMENT TO DON MYLES SECTION 39 AGREEMENT

Councillor Murphy moved to ratify the Telephone Poll of May 3, 2004 Re:  Amendment to Don Myles Section 39 Agreement in that Council reschedule the date for Public Hearing of Objections to June 14, 2004 in regard to the request to amend the Agreement established by Section 39 of the Community Planning Act for the property located at 15 Thompson Road, subject to the deposit in the amount of $1,000 by the applicant to cover the actual costs of legal and advertising costs involved in this application.

Seconded by Councillor Silliphant.  Carried.
