1. CALL TO ORDER - 7:30 P. M.
The Town of Grand Bay-Westfield Council met in a regular session on Monday, August 8, 2005 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE
All members of Council were in attendance with the exception of Councillor Day.

 Councillor McGowan moved to pay Councillor Day in her absence.

 Seconded by Councillor Evans.  Carried.
 
3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Deputy Mayor Murphy moved to adopt the agenda as presented and add item No. 3a - Acknowledgement.

 Seconded by Councillor McGowan.  Carried unanimously.

Mayor and Council offered Councillor Little best wishes on his birthday, August 9th.
 
4.  DISCLOSURE OF CONFLICT OF INTEREST
Councillor McGowan stated a Conflict of Interest with Item No. 24. Memorandum of August 4, 2005 from Planning Advisory Committee Re:  Tentative Subdivision Approval - William & Shirley Silliphant Subdivision - Lot 2005-2, 289 Inglewood Drive/Development Officer’s Report of August 5, 2005.

MLA Milt Sherwood and Mayor Grace Losier presented prizes for the New Brunswick Day Poster Challenge Contest to Corey Armstrong, 11 years old who also accepted the award for his brother Evan Armstrong, 8 years old.

Corporal Landry presented Council with the June and July 2005 RCMP Statistical Reports.

7. MINUTES OF REGULAR COUNCIL MEETING OF JULY 25, 2005
Councillor Evans moved to adopt the minutes of the Regular Council Meeting of July 25, 2005 as presented.

7.1 MINUTES OF FUNDY REGION SOLID WASTE COMMISSION MEETINGS OF
MAY 12, 2005 AND JUNE 16, 2005

Councillor Evans moved to receive and file the minutes of Fundy Region Solid Waste Commission Meetings of May 12, 2005 and June 16, 2005.

Deputy Mayor Murphy moved to pay the Bills for Payment enbloc for a total of $12,280.03 and Bills for Ratification for a total of $154,571.98; grand total of $166,852.01.

BUDGET FINANCIAL REPORT AS AT JUNE 30, 2005

Councillor McGowan moved to receive and file the General Revenue Fund Operating Budget/Sewerage Revenue Fund Operating Budget Financial Report as at June 30, 2005.

 Seconded by Councillor Evans.  Carried.

The Town Manager presented an overview of the Financial Report for the period ending June 30, 2005.
 
16. LETTER OF JULY 25, 2005 FROM HON. BERNARD LORD, PREMIER
RE:  FAMILY AND YOUTH CAPITAL ASSISTANCE PROGRAM (FYCAP) - GRANT APPROVAL

Councillor Evans moved to approve appropriate signatures for Family and Youth Capital Assistance Program (FYCAP) Grant approval in the amount of $10,000 for playground equipment per letter of July 25, 2005 from Hon. Bernard Lord, Premier.

Seconded by Deputy Mayor Murphy.  Carried.
 
17. LETTER OF JULY 12, 2005 FROM GRANT SINCLAIR
RE:  THANK YOU FOR SUPPORT OF TEAM NB 2005

Deputy Mayor Murphy moved to receive and file letter of July 12, 2005 from Grant Sinclair Re:  Thank You for Support of Team NB 2005.

It was noted a plaque was sent to the Town of Grand Bay-Westfield to thank them for their support which will be displayed in the Town office.
 
18. LETTER OF JULY 18, 2005 FROM HÉLÈNE PYE 
RE:  TERRY FOX RUN/DEVELOPMENT OFFICER’S REPORT OF AUGUST 3, 2005 

Councillor Evans moved to approve the proposed Terry Fox Run to be held on Sunday, September 18, 2005 under provisions set out in the Town’s Traffic By-law No. 80, section 6(1) subject to permission of the Team Leader of the RCMP and the District Engineer of the New Brunswick Department of Transportation for the proposed route along River Valley Drive starting at Unity Park. 

 Seconded by Deputy Mayor Murphy.  Carried.

RE:  TENDER RESULTS PROJECT NO. 010-113, STREET UPGRADES 2005 - ROUTE NO. 177

Councillor Little moved to award Tender for Project No. 010-113, Street Upgrades 2005 - Route No. 177 to the lowest bidder, Dean Construction Ltd. for the amount of $259,605 (HST included).

 Seconded by Councillor Evans.  Carried.

It was noted the correspondence of August 3, 2005 from Godfrey Associates Ltd. referenced concerns regarding the low bidder Dean Construction.  The Province will be notified in writing of the concerns.
 
20. FACSIMILE OF AUGUST 3, 2005 FROM JONATHAN SABEAN, P. ENG. OF GODFREY
ASSOCIATES LTD. RE:  TENDER RESULTS  PROJECT  NO. 010-115, PEDESTRIAN SIGNAL, RIVER VALLEY DRIVE

Deputy Mayor Murphy moved to award Tender for Project No. 010-115, Pedestrian Signal, River Valley Drive to Sussex Excavators Ltd. for the amount of $17,900 (HST included).

21. DEVELOPMENT OFFICER’S REPORT OF JULY 29, 2005
RE:  PROPOSED HENDERSON BROOK FISH HABITAT RESTORATION PROJECT

Deputy Mayor Murphy moved to authorize signatures and security in the amount of $5,000 for the completion of approvals from the Department of Fisheries and Oceans to complete the Henderson Brook Fish Habitat Restoration Project, to be conducted by the Department of National Defense during Military Exercises to be held within the Town during the week of August 20-27, 2005.

 Seconded by Councillor Evans.  Carried.

It was noted a Public Information Session will be held by the military on August 17, 2005 to inform residents about the upcoming exercise.
 
22. REQUEST FOR ADVERTISING FROM RED CROSS NEW BRUNSWICK REGION
RE:   HUMANITARIAN AWARDS 2005

Deputy Mayor Murphy moved to refer the request for advertising from Red Cross New Brunswick Region Re:  Humanitarian Awards 2005 to the Town Manager for recommended action.

23.  MEMORANDUM OF AUGUST 4, 2005 FROM PLANNING ADVISORY COMMITTEE
RE:  TENTATIVE SUBDIVISION APPROVAL - PANORAMIC ESTATES SUBDIVISION - PHASE 3 /DEVELOPMENT OFFICER’S REPORT OF AUGUST 5, 2005

Councillor McGowan moved to grant approvals as previously granted by Council regarding street design and Land for Public Purposes for the Tentative Subdivision Plan, Panoramic Estates Subdivision, Phase 3 as prepared by Kierstead Quigley & Roberts Ltd. dated May 9, 2005.

 Seconded by Councillor Evans.  Carried.
 
24. MEMORANDUM OF AUGUST 4, 2005 FROM PLANNING ADVISORY COMMITTEE
RE:  TENTATIVE SUBDIVISION APPROVAL - WILLIAM & SHIRLEY SILLIPHANT SUBDIVISION - LOT 2005-2, 289 INGLEWOOD DRIVE/ DEVELOPMENT OFFICER’S REPORT OF AUGUST 5, 2005

Councillor McGowan departed the meeting at 8:26 p.m. due to a stated Conflict of Interest.

Deputy Mayor Murphy moved to accept the amount of $625.48 as Money in Lieu of Land for Public Purposes for the creation of one new building lot as shown on the Tentative Subdivision Plan, William & Shirley Silliphant Subdivision Lot 2005-2 as prepared by DeSaulniers Surveys Inc. dated July 8, 2005 with approval of the Final Subdivision Plan to be subject to:

a) payment of $625.48 Money in Lieu of Land for Public Purposes;

b) any utility easements as required by NB Power and NB Tel for the servicing of this lot to be recorded on the Plan.

 Seconded by Councillor Evans.  Carried.

 Councillor McGowan rejoined the meeting at 8:28 p.m.
