1..... CALL TO ORDER - 7:30 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, February 8, 2010 with Mayor Losier presiding.

2. RECORD OF ATTENDANCE

Deputy Mayor Archer, Councillor Calvin, Councillor Day and Councillor McGowan were in attendance.  Councillor Murphy was absent.

    Councillor Day moved to pay Councillor Murphy in her absence.

    Seconded by Councillor McGowan.  Carried.

3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved to approve the agenda of Monday, February 8, 2010 as presented.

Seconded by Councillor McGowan.  Carried.

    Cpl. Landry provided information to Council regarding the RCMP Statistical Report for January 2010.  

    Councillor McGowan moved to receive and file the RCMP Statistical Report for January 2010.

    Councillor Day moved to receive and file and have read letter of January 19, 2010 from Tony Simpson, President, River Valley Baseball Association Re:  Thank You to Mayor Losier, Councillors, and Town Staff for New Batting Cage and Relocation of the Storage Shed.

    Councillor McGowan moved to approve Claim No. 2, Tennis Court & Ball Field, Improvements, Inglewood Drive, Project No. 010-150, Certificate No. 2, Final Completion and pay relevant invoices per facsimile of February 3, 2010 from Stephanie Patterson, P. Eng., Dillon Consulting Ltd. subject to a hold back of $2,712.00 as recommended by Dillon Consulting Ltd.

19. LETTER OF JANUARY 13, 2010 FROM HON. DENIS LANDRY, MINISTER OF TRANSPORTATION RE:  ACADIAN COACH LINES INTERCITY BUS SERVICES – ROUTING AND SCHEDULE CHANGES

    Deputy Mayor Archer moved to receive and file letter of January 13, 2010 from Hon. Denis Landry, Minister of Transportation Re:  Acadian Coach Lines Intercity Bus Services – Routing and Schedule Changes.

    It was noted Town Staff would check the NB Energy & Utilities Board website to determine if the bus services changes would affect the Town.

20. MEMORANDUM OF FEBRUARY 3, 2010 FROM PLANNING ADVISORY COMMITTEE RE:  RECOMMENDATION TO COUNCIL RE:  APPLICATION FOR SUBDIVISION APPROVAL – JOANNE KELLY SUBDIVISION, LOTS 1, 2, AND 3, COUNTRY CLUB DRIVE/DEVELOPMENT OFFICER’S REPORT OF FEBRUARY 3, 2010

Deputy Mayor Archer moved to approve the acceptance of $1,705.63 Money in Lieu of Land for Public Purposes (cash, money order, certified cheque or debit) for the purposes of creating two new building lots out of PID No. 30100770 to be located on Country Club Drive as shown on the Tentative Subdivision Plan, Joanne Kelly Subdivision, Lot 1, Lot 2, and Lot 3, as prepared by DeSaulniers Surveys Inc. dated January 18, 2010; with approval of Final Subdivision Plan to be subject to:
a)payment of $1,705.63 (cash, money order, certified cheque or debit);
b)any additional utility easements as required by NB Power & BellAliant for servicing the lots to be recorded and signed on the Final Plan;
c)recording the following Civic Numbers on the Final Subdivision Plan: #20 for LOT 1, # 18 for LOT 2 & #16 for LOT 3;
d)and approval of the Works Commissioner for placement of new driveway culverts.

21. MEMORANDUM OF FEBRUARY 3, 2010 FROM PLANNING ADVISORY COMMITTEE RE:  RECOMMENDATION TO COUNCIL RE:  APPLICATION FOR SUBDIVISION APPROVAL – LINDA DESAULNIERS SUBDIVISION, LOT 10-4 HIGHLAND ROAD/DEVELOPMENT OFFICER’S REPORT OF FEBRUARY 3, 2010

Deputy Mayor Archer moved to accept $129.40, as Money in Lieu of Land for Public Purposes requirements (cash, money order, certified cheque or debit) for the purpose of creating one new building lot on Highland Road, out of PID No. 30118004, as shown on the Tentative Subdivision Plan, Linda E. DeSaulniers Subdivision, Lot 10-4, as prepared by DeSaulniers Surveys Inc. and dated January 27, 2010; with approval of final Subdivision Plan to be subject to:
a)payment of $129.40 (cash, money order, certified cheque or debit);
b)recording of signatures for the Public Utility Easements;
c)recording of Civic Number “157” for Lot 10-4 on the Final Subdivision Plan;
    and approval of the Works Commissioner for placement of new driveway culverts.

22. FACSIMILE OF FEBRUARY 5, 2010 FROM DARCY HARRIS, P. ENG., DILLON CONSULTING LTD. RE:  SITE CLEARING – COLONOL NASE BOULEVARD, GRAND BAY-WESTFIELD, NB, PROJECT NO. 09-2712(A)

Councillor McGowan moved to award the Site Clearing Contract Project No. 09-2712(A) to Matt Harris & Son Ltd. for the Tender Price of $27,326.59 including HST, with work to start immediately on Town owned parcels; however entry will be restricted onto properties identified as PID # 00221218, PID # 30002745, PID # 30002752 and PID # 00221176 until the Town Manager can advise the Contractor that the process for Expropriation for these properties has been completed.

Seconded by Deputy Mayor Archer.  Carried.
