RE: SECTION 39, REZONING, 150 RIVER VALLEY DRIVE, PID NO. 00219246 Councillor Murphy moved whereas, pursuant to By-law 112 (the “Zoning By-law”) and pursuant to Section 39 of the Community Planning Act, being Chapter C-12, SNB (“the Act”), an Application has been received by the Town from Joseph Hohmann, the owner of property at Civic 150 River Valley Drive and having a PID 00219246 (the “Subject Land”), whereby it is proposed that Council re-zone the Subject land from its present Commercial (C) designation to One Family Residential (R1); and whereas Council has agreed to consider the Applicant’s proposal; that the property located at 150 River Valley Drive, PID No. 00219246, be re-zoned from Commercial (C) to One Family Residential (R1), subject to certain conditions: i) existing setbacks as provided by Variances granted by the Planning Advisory Committee on June 1, 2009 be met with Front Yard set backs reduced from 15 m to 2 m from the Elsie Lane right-of-way and the Front Yard setback be reduced from 15 m to 5.4 m from the River Valley Drive right-of-way; and further subject to: ii) all required parking spaces be at the back of the building. and further that: Council establishes the date of October 11, 2011 for a Hearing of Objections for a proposed re-zoning application under Section 39 of the Community Planning Act for consideration of the re-zoning of property located at 150 River Valley Drive, PID No. 00219246; and Council requests the views of the Planning Advisory Committee on the proposed Draft By-law 112 A.
