 CALL TO ORDER - 7:30 PM

The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, September 12, 2011 with Mayor Losier presiding.
2. RECORD OF ATTENDANCE

Deputy Mayor McGowan, Councillor Calvin, Councillor Day, and Councillor Murphy were in attendance.  Councillor Likely was absent.

Deputy Mayor McGowan moved to pay Councillor Likely in his absence.

Seconded by Councillor Day.  Carried.
3. APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS

Councillor Day moved to approve the agenda of Monday, September 12, 2011 as presented with the addition of Item No. 24.a - Request from Holly Richard Re:  Douglas Street/McLean Road.

    Seconded by Deputy Mayor McGowan.  Carried unanimously.

6.1 Presentation of 2011 NB Merit Awards – Mayor Grace Losier and MLA Dr. Jim Parrott Presenters

    Mayor Grace Losier and MLA Dr. Jim Parrot presented 2011 NB Merit Awards to the following individuals:

    Melanie Crowley - Sports, Recreation and Active Living
    Michael & Emily Fox - Arts
    Claudette & Doug Ross - Volunteer Service
    Michael Anderson - Sports, Recreation and Active Living.

    Councillor Day moved to recess for 20 minutes.

6.2 PRESENTATION OF RCMP STATISTICAL REPORT FOR AUGUST 2011 - RCMP REPRESENTATIVE ATTENDING

Cpl. Landry provided information to Council regarding the RCMP Statistical Report for August 2011.
 
    Councillor Day moved to receive and file the RCMP Statistical Report for August 2011.

Seconded by Deputy Mayor McGowan.  Carried.
6.3 PRESENTATION BY MARY REEVES, TOWN REPRESENTATIVE, AQUATIC CENTRE

Mary Reeves, Town Representative for the Aquatic Centre provided information to Council regarding Aquatic Centre operations.

Councillor Day moved to receive and file presentation by Mary Reeves, Town Representative, Aquatic Centre.

    Seconded by Councillor Murphy.  Carried.

Councillor Calvin moved to adopt the minutes of the Regular Council Meeting of August 8, 2011 as presented.

7.2 MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF JUNE 20, 2011

Councillor Murphy moved to receive and file minutes of Planning Advisory Committee Meeting of June 20, 2011.

7.3 TELEPHONE POLL OF AUGUST 19, 2011 RE:  DEMAND LOANS

Councillor Murphy moved to ratify Telephone Poll of August 19, 2011 in that authorization be granted to establish a Demand Loan at the Bank of Nova Scotia for $200,000 in relation to Ministerial Approval No. 10-0098 for Environmental Health Services and for $411,279 in relation to Ministerial Approval No. 10-0056 for Transportation Services.

7.4 Tender Opening Notes of September 1, 2011 Re:  Energy Retrofits, Project No. 11-EPI (MON-00201312-AD)

    Councillor Murphy moved to receive and file Tender Opening Notes of September 1, 2011 Re:  Energy Retrofits, Project No. 11-EPI (MON-00201312-AD).

    Seconded by Deputy Mayor McGowan.  Carried.

Councillor Day moved to pay the Bills for Payment in the amount of $141,337.19 and Bills for Ratification in the amount of $108,180.04; Grand Total of $249,517.23.

LETTER RECEIVED AUGUST 10, 2011 FROM RICHARD MCLEAN, FORMER TOWN REPRESENTATIVE ON THE FUNDY REGION SOLID WASTE COMMISSION RE:  LETTER OF APPRECIATION

    Councillor Murphy moved to receive and file letter received August 10, 2011 from Richard McLean, Former Town Representative on the Fundy Region Solid Waste Commission Re:  Letter of Appreciation.

    Seconded by Councillor Day.  Carried.

    The letter from Mr. McLean was read for the record.

TOWN MANAGER’S REPORT OF AUGUST 16, 2011 RE:  DEMAND LOAN - MINISTERIAL APPROVAL NO. 10-0105
  
    Deputy Mayor McGowan moved to grant authorization for a Demand Loan at the Bank of Nova Scotia regarding Ministerial Approval No. 10-0105 concerning 2010 General Capital Borrowing Re:  Protective Services with the Loan not to exceed $380,000 for a term of one year.

    Seconded by Councillor Calvin.  Carried.
18. LETTER OF SEPTEMBER 6, 2011 FROM C. MEAHAN MACPHERSON, EXP SERVICES INC. RE:  RECOMMENDATION AND REVIEW OF TENDER PRICES - PROJECT NO. MON-00201312-AD, ENERGY RETROFITS

    Councillor Murphy moved to award Project No. MON-00201312-AD, Energy Retrofits to the lowest bidder JDA Electric Ltd. for the bid price of $66,133.25 which includes HST.

19. LETTER OF SEPTEMBER 7, 2011 FROM STEPHANIE PATTERSON, P. ENG., DILLON CONSULTING LTD. RE:  STORM SEWER IMPROVEMENTS 2010, INGLEWOOD DRIVE - WOOLASTOOK DRIVE, PROJECT NO. 10-3270, REPORT NO. 13

    Councillor Calvin moved to approve Storm Sewer Improvements 2010 Inglewood Drive - Woolastook Drive, Project No. 10-3270, Report No. 13 in the amount of $122,545.14 with authorization for payment of relevant invoice per recommendation of September 7, 2011 from Stephanie Patterson, P. Eng., Dillon Consulting.

20. LETTER OF SEPTEMBER 7, 2011 FROM STEPHANIE B. PATTERSON, P. ENG., DILLON CONSULTING LTD. RE:  COMMERCIAL CORE COLLECTOR ROADWAY (COLONEL NASE BOULEVARD) GRAND BAY-WESTFIELD, NB, RDC PROJECT NOS. 4253.037.013 AND 9135.200.001, PROJECT NO. 010-149, CLAIM NO. 29

Councillor Murphy moved to approve  Commercial Core Collector Roadway (Colonel Nase Boulevard) Grand Bay-Westfield, NB, RDC Project Nos. 4253.037.013 and 9135.200.001, Project No. 010-149, Claim No. 29 in the amount of $321,101.32 with authorization for payment of relevant invoices per letter of September 7, 2011 from Stephanie B. Patterson, P. Eng., Dillon Consulting.

LETTER OF AUGUST 31, 2011 FROM CLAYTON ROGERS, P. ENG., DILLON CONSULTING LTD. RE:  ASPHALT RESURFACING 2011, INGLEWOOD, WOOLASTOOK & CENTRUM PROJECT NO. 11-4750, CERTIFICATE NO. 2

    Councillor Murphy moved to approve Asphalt Resurfacing 2011, Inglewood Drive, Woolastook Drive and Centrum Project No. 11-4750, Certificate No. 2 in the amount of $307,316.62 to Classic Construction per letter of August 31, 2011 from Clayton Rogers, P. Eng., Dillon Consulting.

22. DEVELOPMENT OFFICER’S REPORT OF SEPTEMBER 7, 2011 RE:  REPORT BY EXP SERVICES INC. DATED SEPTEMBER 2011 - BICYCLE FACILITY REVIEW ON HIGHLAND ROAD

    Councillor Day moved to receive and file Development Officer’s Report of September 7, 2011 Re:  Report by EXP Services Inc. dated September 2011 - Bicycle Facility Review on Highland Road.

23. WORKS COMMISSIONER’S REPORT OF SEPTEMBER 6, 2011 RE:  DESIGNATED HIGHWAY 5 YEAR PLAN 2012-2016

    Councillor Day moved to adopt the Town Designated Highway 5 Year Plan 2012 – 2016 per Works Commissioner’s Report of September 6, 2011 and forward a copy to the Department of Transportation and to MLA Dr. Jim Parrot.

24. DEVELOPMENT OFFICER’S REPORT OF AUGUST 30, 2011 RE:  SECTION 39, REZONING, 150 RIVER VALLEY DRIVE, PID NO. 00219246

Councillor Murphy moved whereas, pursuant to By-law 112 (the “Zoning By-law”) and pursuant to Section 39 of the Community Planning Act, being Chapter C-12, SNB (“the Act”), an Application has been received by the Town from Joseph Hohmann, the owner of property at Civic 150 River Valley Drive and having a PID 00219246 (the “Subject Land”), whereby it is proposed that Council re-zone the Subject land from its present Commercial (C) designation to One Family Residential (R1);

and whereas Council has agreed to consider the Applicant’s proposal;

that the property located at 150 River Valley Drive, PID No. 00219246, be re-zoned from Commercial (C) to One Family Residential (R1), subject to certain conditions:

i) existing setbacks as provided by Variances granted by the Planning Advisory Committee on June 1, 2009 be met with Front Yard set backs reduced from 15 m to 2 m from the Elsie Lane right-of-way and the Front Yard setback be reduced from 15 m to 5.4 m from the River Valley Drive right-of-way;

and further subject to:

ii) all required parking spaces be at the back of the building.

and further that:

Council establishes the date of October 11, 2011 for a Hearing of Objections for a proposed re-zoning application under Section 39 of the Community Planning Act for consideration of the re-zoning of property located at 150 River Valley Drive, PID No. 00219246; and

Council requests the views of the Planning Advisory Committee on the proposed Draft By-law 112 A.

24. a REQUEST FROM HOLLY RICHARD RE:  DOUGLAS STREET/MCLEAN ROAD

    Councillor Day moved to refer the request from Holly Richard for additional paving on Douglas Street and McLean Road (estimated at $60,000) to the General Capital Budget process for possible future consideration.

    Seconded by Deputy Mayor McGowan.  Carried.
