The Town of Grand Bay-Westfield Council met in a Regular Session on Monday, September 11, 2006 with Mayor Losier presiding.

RECORD OF ATTENDANCE

Deputy Mayor Murphy, Councillor Little, Councillor McGowan, Councillor Day, and Councillor Evans were in attendance.
 

3.  APPROVAL OF THE ORDER OF BUSINESS AND APPROVAL OF ADDITIONS AND DELETIONS
Councillor Day moved to approve the agenda of September 11, 2006 as presented.

Seconded by Councillor McGowan.  Carried.

6. PUBLIC PRESENTATIONS
6.1  RCMP STATISTICAL REPORT FOR AUGUST 2006 - RCMP REPRESENTATIVE ATTENDING
Cpl. Landry was in attendance to respond to inquiries from Council regarding the RCMP Statistical Report for 
August 2006.

 Deputy Mayor Murphy moved to receive and file the RCMP Statistical Report for August 2006.

 Seconded by Councillor McGowan.  Carried.
 

6.2 PRESENTATION
RE:  PROPOSED RUNNING TRACK AT RIVER VALLEY MIDDLE SCHOOL - JOE OLIVER, CHAIRMAN, RIVER VALLEY COMMUNITY TRACK ASSOCIATION PRESENTER

 Joe Oliver, Chairman, River Valley Community Track Association presented Council with details concerning the proposed Running Track at River Valley Middle School.

 Councillor McGowan moved to refer the presentation from the River Valley Community Track Association to the Recreation Director and the Works Commissioner for a report to return to Council.

 Seconded by Councillor Evans.  Carried.

 A request was made for minutes from the River Valley Community Track Association Meetings to be provided to the Town Recreation Director.
 

6.3 PRESENTATION  OF AWARDS 
BY THE GRAND BAY-WESTFIELD VOLUNTEER FIRE/RESCUE DEPARTMENT RE:  YEARS OF SERVICE, RETIREMENT, AND ADVANCEMENT TO 1ST CLASS FIREFIGHTER - FIRE CHIEF AND MAYOR LOSIER PRESENTERS

 Councillor McGowan moved to table the presentation of awards by the Grand Bay-Westfield Volunteer Fire/Rescue Department Re:  Years of Service, Retirement, and Advancement to 1st Class Firefighter to the September 25, 2006 Council Meeting.

 Seconded by Deputy Mayor Murphy.  Carried.
 

7. MINUTES OF REGULAR COUNCIL MEETING OF AUGUST 14, 2006
Deputy Mayor Murphy moved to adopt the minutes of the Regular Council Meeting of August 14, 2006 as presented.

Seconded by Councillor Day.  Carried.
 

7.1 PLANNING ADVISORY COMMITTEE MEETING MINUTES OF JULY 17, 2006
Councillor McGowan moved to receive and file minutes of the Planning Advisory Committee Meeting of July 17, 2006.

 Seconded by Deputy Mayor Murphy.  Carried.
 

7.2 TENDER NOTES OF AUGUST 24, 2006
RE:  STORM SEWER IMPROVEMENTS 2006, PROJECT NO. 010-120

Councillor McGowan moved to receive and file Tender Notes of August 24, 2006 Re:  Storm Sewer Improvements 2006, Project No. 010-120.

 Seconded by Councillor Day.  Carried.
 

7.3 TENDER NOTES OF SEPTEMBER 6, 2006
RE:  1½ TON 4X4 TRUCK CAB & CHASSIS

Councillor McGowan moved to receive and file Tender Notes of September 6, 2006 Re:  1½ Ton 4x4 Truck Cab & Chassis.

 Seconded by Deputy Mayor Murphy.  Carried.
 

8. BILLS FOR PAYMENT
Councillor Day moved to pay Bills for Payment enbloc for a total of $34,025.09 and Bills for Ratification for a total of $77,375.88; grand total of $111,400.97.

RE:  REQUEST FOR STREET UP-GRADING, REPAIRS, AND PAVING 

Deputy Mayor Murphy moved to refer the request for street upgrading on Kenwood Road, First Street, and Harris Road to the 2007 Capital Budget process and to forward a letter to Mr. Malcolm Harris to inform him and the residents about the Town’s Street Condition Study.

P. ENG., DIRECTOR, DEPARTMENT OF TRANSPORTATION RE:  SUBMISSION OF FIVE YEAR PRIORITIES - DESIGNATED HIGHWAY PROGRAM/BROUGHT FORWARD FROM AUGUST 14, 2006/WORKS COMMISSIONER’S REPORT OF AUGUST 29, 2006

Councillor Day moved to adopt the Designated Highway 5 Year Plan 2007-2011 per Works Commissioner’s report of August 29, 2006 and forward the Plan to the Department of Transportation.

Seconded by Deputy Mayor Murphy.  Carried.

Staff will determine if any conflict would occur between proposed 2007 Designated Highway work and proposed Running Track Project.

Councillor Day moved to approve Progress Invoice No. 3 in the amount of $97,131.57 per correspondence of August 8, 2006 from Stephanie B. Patterson, Godfrey Associates Ltd. Re:  Street Upgrading 2006, Route No. 177 (Mullen Lane to Hillandale Drive), Project No. 010-118 and authorize payment of relevant invoices.

Councillor Day moved to approve Claim No. 4 in the amount of $111,562.37 per letter of August 14, 2006 from Stephanie B. Patterson, P. Eng., Godfrey Associates Ltd. Re:  Waterfront Development, Brundage Point Trailhead, Grand Bay-Westfield, NB, Project No. 010-116 and authorize payment of relevant invoices.

19. LETTER OF AUGUST 24, 2006 FROM CLAYTON ROGERS, P. ENG., GODFREY ASSOCIATES LTD. 
RE:  STORM SEWER IMPROVEMENTS - 2006, PROJECT NO. 010-120 RE:  RECOMMENDATION TO AWARD CONTRACT

 Deputy Mayor Murphy moved to award the contract to the low tenderer, Keel Construction Ltd., for the Tender Price of $231,092.00 per letter of August 24, 2006 from Clayton Rogers, P. Eng., Godfrey Associates Ltd.  Re:  Storm Sewer Improvements - 2006, Project No. 010-120.

 Seconded Councillor McGowan.  Carried.
 

20. LETTER OF AUGUST 24, 2006 FROM CLAYTON ROGERS, P. ENG., GODFREY ASSOCIATES LTD. 
RE:  STREET IMPROVEMENTS 2006, VARIOUS LOCATIONS, PROJECT NO. 010-119, CERTIFICATE NO. 2 - FINAL COMPLETION

 Councillor Day moved to pay $20,151.55 per Certificate No. 2 - Final Completion to Classic Construction per letter of August 24, 2006 from Clayton Rogers, P. Eng., Godfrey Associates Ltd. Re:  Street Improvements 2006, Various Locations, Project No. 010-119.

 Seconded by Deputy Mayor Murphy.  Carried.
 

21  LETTER OF AUGUST 30, 2006 FROM BARRY OGDEN, TEACHER, SAINT JOHN HIGH SCHOOL 
RE:  THANK YOU TO TOWN STAFF RE:  MARIGOLD PROJECT

 Deputy Mayor Murphy moved to receive and file letter of August 30, 2006 from Barry Ogden, Teacher, Saint John High School Re:  Thank You to Town Staff Re:  Marigold Project.

 Seconded by Councillor Evans.  Carried.

 It was also noted that the Sponsors, the Recreation Department, the Works Department, the Students, and the Beautification Committee contributed to making the project a success.
 

22.  WORKS COMMISSIONER’S REPORT OF SEPTEMBER 6, 2006 RE:  TRUCK TENDER 010T-06
Councillor Evans moved that the one tender received from Downey Ford Lincoln for Tender 010T-06 be rejected as it is not in compliance with the Terms and Conditions, Rejections section 1 (a) and that staff be authorized to contact various dealers to obtain prices for a suitable truck directly off the lot which will meet the needs of the Works Department and the 2006 allocated budget.

Seconded by Councillor McGowan.  Carried.
