CALL TO ORDER

The Town of Grand Bay-Westfield Council met in a regular session on September 23, 2002 at 7:40 p.m.
with Mayor Losier presiding.

6.1  PRESENTATION OF DONATION TO DARE PROGRAM - CST. NORM ADAMS ATTENDING
Mayor Losier presented Cst. Norman Adams with a cheque in the amount of $500.00 for the D.A.R.E. Program.
 
6.2  RCMP STATISTICAL REPORT FOR AUGUST 2002 - CPL. GREG GRANT ATTENDING
Corporal Grant was not available to attend and in his absence Cst. Jeff Cole presented the RCMP Statistical Report for August 2002.

Deputy Mayor McGowan moved to receive and file the RCMP Statistical Report for August 2002.

Seconded by Councillor Day.  Carried.

 The following matters were referred to the RCMP:

  • RCMP French/English recording
  • call forwarding to RCMP vehicle cell phones
  • parents parking when discharging children or waiting for school bus.
6.3 PRESENTATION OF DRAFT MUNICIPAL PLAN BY-LAW NO. 100 - REPRESENTATIVES OF
SGE ACRES ATTENDING

Chris Lowe and Jeff Ward Consultants from SGE Acres gave a presentation on the Draft Town of Grand Bay-Westfield Municipal Plan and discussed the following topics:

Development Strategy
Plan Policies
Budget and Implementation
Generalized Future Land Use Map
Transportation Plan
Environmental Protection Plan.

The public was advised that they now have 30 days to provide input on the Draft Municipal Plan.  It was also noted that a Public Hearing would be held following the 30 day period.  The public hearing will be advertised throughout the community.

Councillor Day moved to receive as presented the Town of Grand Bay-Westfield Draft Municipal Plan By-law.

Seconded by Deputy Mayor McGowan.  Carried.

MINUTES OF REGULAR COUNCIL MEETING SEPTEMBER 9, 2002

Councillor Day moved to adopt the minutes of the regular Council meeting of Sept. 9, 2002 as presented.

7.1  MINUTES OF PLANNING ADVISORY COMMITTEE MEETING OF SEPTEMBER 3, 2002
Councillor Silliphant moved to receive and file the minutes of the Planning Advisory Committee meeting of September 3, 2002.

BILLS FOR PAYMENT

Councillor Day moved to pay the Bills for Payment enbloc for a total of $129,651.10 and approve the Bills
for Ratification for a total of $33,123.14, Grand Total $162,774.24.

13.4 RESOLUTION TO DECLARE AN EMERGENCY RE:  BY-LAW NO. 90, TOWN OF

Councillor Silliphant moved to Declare an Emergency Re:  By-law No. 90, Town of Grand Bay-Westfield By-law Respecting Disturbance by Noise.

Seconded by Councillor Day.  Carried unanimously.

13.6 THIRD READING BY TITLE AND ENACTMENT OF BY-LAW NO. 90, TOWN OF

Deputy Mayor McGowan moved Third Reading by Title and Enactment of By-law No. 90, Town of Grand Bay-Westfield By-law Respecting Disturbance by Noise.

Seconded by Councillor Day.  Carried.

By-law No. 90 was read a third time and enacted.
 

13.7 DRAFT LETTER OF UNDERSTANDING RE:  RCMP/NOISE BY-LAW
Councillor Day moved to authorize appropriate signatures to execute the Draft Letter of Understanding dated September 23, 2002 between the Town of Grand Bay-Westfield and the District Commander of the RCMP under Section 2 (e) of the Police Service Agreement for the enforcement by the RCMP of the Town By-law, Town of Grand Bay-Westfield By-law No. 90 and any amendments thereto.

Councillor Silliphant moved to receive and file Lorneville Community & Recreation Association Documentation Re:  Conversion of the Coleson Cove Generating Station to Burn Orimulsion fuel.

Deputy Mayor McGowan moved to receive and file letter of September 9, 2002 from Mary Munford, Common Clerk, City of Saint John Re:  Development of a Fundy Regional Council.

19.  TOWN MANAGER’S REPORT OF SEPTEMBER 11, 2002
RE:  APPOINTMENTS TO TOURISM COMMITTEE

Deputy Mayor McGowan moved to appoint Pam McKay to the Tourism Committee as a voting member effective immediately.

20. WORKS COMMISSIONER’S REPORT OF SEPTEMBER 12, 2002
RE:  EASEMENT AND RELEASE OF EASEMENT, 25 GEORGE STREET

Councillor Day moved to authorize the Mayor and Town Manager (Clerk) to execute the easement release and easement documents prepared by Solicitor Poley regarding the property at 25 George Street.

Seconded by Deputy Mayor McGowan.  Carried.
 

21. LETTER OF SEPTEMBER 17, 2002 FROM IMPERIAL THEATRE INC.
RE:  APPOINTMENT OF TOWN REPRESENTATIVE TO IMPERIAL THEATRE BOARD

Deputy Mayor McGowan moved to table letter of September 17, 2002 from Imperial Theatre Inc. Re:  Appointment of Town Representative to Imperial Theatre Board until the next Council meeting of October 15, 2002.

22. LETTER OF SEPTEMBER 9, 2002 FROM ENVIRONMENT AND LOCAL GOVERNMENT
RE:  2002 ENVIRONMENTAL LEADERSHIP AWARDS/RELEVANT PRESS RELEASE

Councillor Day moved to receive and file letter of September 9, 2002 from Environment and Local Government Re:  2002 Environmental Leadership Award/Relevant Press Release.

23. E-MAIL FROM STEVEN FLOYD, PANORAMIC ESTATES
RE:  REQUEST FOR EXTENSION TO DEVELOPER’S AGREEMENT FOR PANORAMIC ESTATES/DEVELOPMENT OFFICER’S REPORT OF SEPTEMBER 17, 2002

Deputy Mayor McGowan moved to extend the one year requirement to complete the work set out in Subdivision Developer’s Agreement for Panoramic Estates, Phase 1, dated September 14, 2001 based on a request from the developers and confirmation from Contractor QM Construction to complete the work as set out in the agreement on or before October 31, 2002.

Seconded by Councillor Day.  Carried.
